| C5 Web Designs Terms and Conditions General C5 Web Designs will carry out work only where an agreement is provided either by email, telephone, mail or fax. C5 Web Designs will carry out work only for clients who are 16 years of age or above. An 'order' is deemed to be a written or verbal contract between C5 Web Designs and the client; this includes telephone and email agreements. Each client will be assigned a dedicated webmaster for his or her account; each client will have their own personal webmaster. Domains bought with C5 Web Designs are property of C5 until full payments are made, then the client will officially own his or her site. Contract terms are for 1 year, after a year if you wish to renew your account, you can do so for $180. All your current features will be valid for one more year. Or the client has the option to pay the $15 monthly payment, by doing this, you will not need to pay to renew at the end of the year. Website Design While every endeavor will be made to ensure that the website and any scripts or programs are free of errors, C5 Web Designs cannot accept responsibility for any losses incurred due to malfunction, the website or any part of it. The website, graphics and any programming code remain the property of C5 Web Designs until all outstanding accounts are paid in full. Any scripts, cgi applications, php scripts, java, or software (unless specifically agreed) written by C5 Web Designs remain the copyright of C5 Web Designs and may only be commercially reproduced or resold with the permission of C5 Web Designs. Selling or reproducing any scripts or codes done custom for your site without consent of C5 Web Designs will result in fees or your site being deleted. C5 Web Designs cannot take responsibility for any copyright infringements caused by materials submitted by the client. We reserve the right to refuse and or delete any material of a copyrighted nature unless adequate proof is given of permission to use such material. Be careful what you put on your site. C5 Web Designs will not be liable or become involved in any disputes between the site owner and their clients and cannot be held responsible for any wrongdoing on the part of a site owner. eg. Any disputes re content/images that have been provided to us for inclusion on the site. C5 just makes the site and plays no part in how the site owner deals with his or her clients/users. C5 Web Designs will not be liable for any costs incurred, compensation or loss of earnings due to the work carried out on behalf of the client or any of the clients appointed agents. C5 Web Designs will not be liable for costs incurred, compensation or loss of earnings due to the failure to meet agreed deadlines. We will do everything we can to meet any deadlines you have set but any money lost if a deadline is not met is not the responsibility of C5 Web Designs. C5 Web Designs is not responsible for content on websites done by an individual outside of C5 Web Designs. If you choose to have C5 Web Designs take over your current site, you will be responsible for hosting fees and that hosting companies terms along with C5 terms. Depending on the situation, your C5 webmaster may not charge full web design payment if you are paying for a 3rd party host, any website that will have full flash pages done by C5 or maintained by C5 must pay for the full package. No discounts will be given for websites with full flash pages. If you choose to have C5 Web Designs take over a website that is hosted, designed, and created by a company or individual outside of C5 Web Designs, all of our basic features will be included in your package price. Including Free 24/7 updating, Unlimited pages (except Flash) Unlimited data, Free 24/7 Phone support, up to 10 Email accounts, Custom Graphics, ect. Email Accounts Website packages bought with C5 Web Designs are allowed up to 10 private email accounts (example johnsmith@yoururl.com) Emails sent from these accounts are all linked to a private Yahoo email account which the client will only have access to. Email accounts are only valid as long as the website is up and running and paid for. If a client decides not to renew his or her account all email accounts will be deleted. Any content sent or received in the clients email account is his or her responsibility. C5 Web Designs is not responsible for what the client does on their email accounts. Websites designed and hosted by a company or individual outside of C5 Web Designs will need to be reviewed to see if email accounts are possible. Ask your C5 Webmaster for more details. Updating C5 Web Designs will update any clients site 24/7 and for free. 99% of the time, sites are updated within the hour, but in rare cases it may be up to 3 or 4 hours. Also, some web browsers do not show updates after they are made, so be patient. As of now, we do not allow clients to update their own sites, any updates you want for your site will be done by a C5 Webmaster. Website Optimization Due to external factors, such as changes to the way search engines rank websites, we cannot offer any guarantees regarding the position we will achieve for your website. The process of optimizing websites itself will bring in more traffic and hits and you'll see visits increase to your site naturally. We cannot accept liability for any change in rankings, or drop off in the position of your website due to changes in the algorithms of the search engines or the factors that they use to rank websites. Basically, your site is ranked based on traffic and popularity on search results. C5 cannot make your site rank better. Marketing C5 Web Designs offers marketing through "pay per click ads" and "pay per view ads" through Google. All marketing information will be on a third party server and C5 Web Designs is not responsible for any content on those servers. The client will be able to view and make payments on Google's site and will have their own account, C5 Web Designs will not have access to this account unless the client agrees to give access. The client will either be given an HTML code, or will have to do a sort of phone verification to ensure their website is safe, this is normal and should not cause any problems. Payment Payment must be upfront and in full. We do not start the design process until payment has been made and cleared. All orders over $700.00 are eligible for half now half later plans, but remaining half will be due within 10 days. Until full payment has been made, C5 Web Designs owns the site and domain name – domain and site will be transferred after payments are finalized. C5 Web Designs charges no hourly, fees or any other design fee. $180 will be due at the end of the year to renew your site. C5 will not charge a late fee for late payments, but will expect payment by the end of the month. Features such as E-Commerce or other products that require monthly fees will be expected to be paid at the 1st of each month. Other -Updated 10/10/09 |
